I have a suggestion for everyone who reads this blog,everyone who has been affected by Michael Jolly and Trent Jolly,everyone who has worked for him and everyone who has previous or current outstanding issues with Jolly ,Vollay etc
Write to ASIC  and add to the growing list of people who have contacted them over the years The more people that contact them , the more chance that they will do something about it before Jolly disappears from the country with all his stashed money and retires to the Sth of France This guy needs to be made accountable and people power will do the job so start today and write to the Misconduct and Breach reporting team and tell them everything and maybe we will get the result we all want

Montage Group Pty Ltd has now been wound up owing $$$millions
They have continued to run Vollay Systems and Vollay Contract and now Shade Systems in the same manner by taking deposits from customers and not delivering the goods in a timely manner
 6 to 8 weeks is acceptable
Anything longer than this is not
 Some customers still waiting for action after 3 years!!! And they are unlikely to get anything
The depth of this matter can only be achieved if you make it known to others .While the Administrators had some idea of the issues and have contacted some creditors , there are still many companies and customers who have been left high and dry after paying over thousands of dollars as deposits. In many cases I believe that this money has been taken while the company knew of its insolvency issues so therefore they could in breach of Section 36 of the Australian Consumer Law which has financial and custodial penalties
It is important that all these issues are bought to light so as to prevent these companies from continuing operating which is doubtful under the circumstances

  2. I to have been having a lot of problems with this company. I paid a substantial deposit last year and continue to get nothing from them except excuses. Without doubt the most unpleasant experience i have ever had with any company in my time on this planet. I have had many discussions with this organisation, particularly Michael Jolly, and i can say with no fear of contradiction that they have never done anything they said they would. I would warn anyone possible to have nothing to do with them.

    he takes deposits with no intention to supply goods he has taken many hundreds of Thousands of Dollars from hard working people and not supplied them with anything

  5. SO SIMPLE - CHECK THE REGULATIONS & KNOW YOUR RIGHTS

    Before dealing with Montage Group Pty. Ltd. (Vollay Contracts Pty Ltd) carefully check the regulations with NSW Dept. of Fair Trading.

    Ask Michael Jolly of Montage Group if his company is licenced for domestic work.
    Be sure to obtain the licence No. and check its validity with NSW Dept. of Fair Trading. Do not proceed without obtaining a valid licence No.

    For domestic shutters, louvre roof installations or similar, it is illegal to demand an initial deposit greater than 10%. Progress payments may be legally requested.
    Check with NSW Dept. of Fair Trading.

    For any domestic installation where total cost is $1,000 or more, installers must have a basic builder’s licence. Be sure to ask for the licence No. and check its validity with Fair Trading. If there is no valid licence, the warranty not be valid. Check with NSW Dept. of Fair Trading.

    For any domestic installation where total cost is $12,000 or more, installers must have appropriate builder’s licence. Be sure to ask for the licence No. and check its validity with Fair Trading. If there is no valid licence, there is no valid warranty.

    Where the total cost of the installation is $12,000 or more, a ‘Home Owners Warranty Insurance Certificate’ must be issued to the home owner. A Home Owners Warranty Insurance Certificate cannot be issued if the installer does not hold the appropriate licence. Do not proceed if there is no licence and no Home Owners Warranty Insurance Certificate. Check with NSW Dept. of Fair Trading

    If you are given no Home Warranty Insurance, and if the installers are unlicenced, you may find yourself in a very difficult position.
    Check with NSW Dept. of Fair Trading.

    If there are excessive delays, report the matter to NSW Dept. of Fair Trading.

    If you demand the return of your deposit and encounter any resistance or delay, report the matter promptly to NSW Dept. of Fair Trading.

    Do not allow installers to commence work till you have checked that they are properly licenced. Check that the installer is the holder of the licence No. quoted by Montage Group (Vollay). If there are any difficulties, report straight to Fair Trading.

    Make sure that you have appropriate development approval for any installation.

  6. Montage Group, Vollay Contract and Michael Jolly have been spending some time in the courts over the last few weeks and only this week had the locks changed at their premises in Seven Hills
    He managed to come up with the money to keep the wolves at bay a little longer Either he had money in a secret account(likely) OR probably paid the money with a customers deposit he recieved for new work
    I still can't believe that people pay deposits without checking on the credibility of companies like this
    Either this money is gone for good or you MAY get your goods in 6 months-12 months

  7. On a cheering note i heard tonight that one of michaels creditors dragged him out of his shop and gave him a bit of a hiding a few days ago. Not that i condon violence of course but it did cheer me up to hear it!!!!

    I spent some time with my lawyer last week and he said while there is virtually nothing i can do against the montage/vollay company while they are under a "Deed of Company Arrangement" there is opportunity to have a tilt at michael personnaly as a director although it would likely be a reasonably expensive exercise. Apparently michael and his family have been considered crooks by many in the industry for many years. I am surprised that there is not some mechanism to put the bastards out of business.

  8. I too have had many unfortunate dealings with Michael,Jill and Trent JOLLY. I have lost in excess of $150k through failed deliveries, broken promises and the normal Jolly excuses. In particular there V7000 opening and closing roof is a total nightmare , with no testings available and it leaks like a sieve. Michael JOLLY is not a man of his word and honors no warranties , despite offering ten years. I wouldn't trust him if he was the last man standing.

  9. Michael Jolly. Where do I start. Any body who trust this guy, his wife , son or anybody associated with this family , have rocks in their head. He even used his wifes inheritance money from her dad to try and buy his way out of trouble a couple of years ago. He transfers all assets into his son,daughters, wifes,fathers names so he avoids getting trapped. He takes deposits knowing the he can't deliver. He has traded whilst effectively being insolvent. What is wrong with the law in Australia. Dirt bags like this should not be allowed to trade. I would love a dollar for every person he has crossed. I would be a millionare. He even shit on his rep, Brent PARKES. He has had issues with nearly every staff memeber who works for him and most contractors. He is the master of bullshit, promising the earth and fails to deliver. Sure you will get some of your order with no manifest, things missing , every excuse under the sun and than some. One day the system will catch up with him. Do youself a favour if you are reading this, don't trust or deal with Michael JOLLY. You have been warned. I have been burnt big time. almost bank rupted by failure to deliver. I have had to return deposits to clients and than provide alternative systems to satisfy clients wjhere Jobs had been started , but gear missing. It has cost me a fortune, not to mention my marraige. Yes Michael JOLLY was the major cause of my marraige breakup as my wife couldn't handle all the lies and customers repeatedly phoning complaining about gear that had not arrived. I hope he burns in hell...........

  11. Haha, As a creditor I have just recieved a letter in the mail today from the Administrators Dean-Willcocks Shepard.
    It would appear Michael Jolly is in a dire disposition, having not met his payment arrangement for the months of October and November, add to this this he most likely wont make this months payment either, a meeting with the Administrators is to held for all creditors set for Thursday 3 January 2013 at Level 2 32 Martin Place Sydney at 10.00am. I urge all creditors to be present and vote on the proxy form to Terminate the Deed and wind up the company. Also to voice an opinion that this man NOT continue to Trade under the name of Volley, which would appear how he has managed to avoid any responsibilities over from Montage. Please turn up in force to wipe this parasite from ever trading again.

  12. Jolly (trading as Montage or Vollay) has insufficient cashflow to run his business efficiently. He is unable maintain adequate stock for timely delivery of orders
    He has insufficient production staff to fabricate the goods that he takes orders and deposits for. He has no forward planning, and no idea of how to run a business.

    Suppliers are kept on a ‘drip-feed’ or demand payment before delivery. Jobs are typically at least 6 to 8 months behind schedule, because he has no materials, has no money to pay for them, and has insufficient production capacity.

    Incoming deposits are used to keep suppliers on a ‘drip feed’, for weekly payroll, general expenses and to fund production and delivery of orders for which deposits were taken months ago and the customers are now threatening action.

    Jolly keeps customer phone numbers on his mobile phone so that he can avoid answering complainers. If you’re an angry customer and you ring the office, you will be put on hold while the receptionist tells Jolly that you have phoned and asks him if he wants to talk to you. He may talk to the angry customer and make excuses, or he will tell the receptionist to say that he is “in a meeting”, “out on site”, “in New Zealand” or whatever. He may promise to return your call, but don’t hold your breath. I’ve been in his office, I’ve seen it happen. He thinks it’s funny.

    Jolly, (Montage, Vollay) have been reported to the ACCC and to ASIC, but they have chosen to do nothing and let this operation continue. The Dept. of Fair Trading has fined him numerous times and given him warnings, but a $5,500 fine means nothing to someone who has built debts of about $4M. Fair Trading displays Public Warnings about others, but does not see fit to issue a warning about Jolly/Montage/Vollay. They just sit back and let the public walk into the trap.

To anyone owed money by this grub, please be aware that after talking to the Administrator, Dean - Willcocks Shepard, contact person Cameron phone 02 9234 0400, I was informed that Michael Jolly / Montage Group has to pay $30K on or before 20th January 2013. Should he fail to do this, the Administrator will call for a creditors meeting and I urge every Creditor to attend this meeting either in person or by telephone link up (conference number 02 9234 0400). If there is sufficient creditors who vote to wind up this grub, ie 10 people, the administrator will be obligated to liquidate the company. So your vote is very important. I also ask that you request the administrator to make a full report to the ACCC in regards to the the actions by the Jolly family as they are unfit to hold a Directorship of any Company.

    I think is time to get united and put pressure on administrators to liquidate Montage.There is a lot of creditors,let vote Jollys into their commercial grave.
    Anyone who sill think that gets something from Montage should get theirs head checked.From my experience all i got is lies,promises,lies and moreempty promises.
    Get sign petition to ACCC to get him for all his actions.For trading while insolvent.We cannot get him to walk away.
    If everyone call their local federal member about it ACCC will have no choice but start investigation.

    1. Well that was well said, I did manage to understand most parts of what you were saying.
      However, Jolly doesn't give a fuck about Montage. That company no longer is an interest to him, it's basically dead in the water. Vollay is where it counts, and he shifts money around within that name, having two entities (Contract) and (Systems)
      For my mind, he's like the Al Capone of Sydney, laundering money where he needs to. I will bet anything that he comes up the 30K to keep trading.

    There's nothing ACCC can do to pin this cold blooded garbage Jolly and family and companies unless you all wakeup and put words to action!

    I almost got burnt 2 years ago(near 1M) ,been in court with jolly and his company.Almost got this bastard,Again it's because of the Australian law that he got away with it temporarily,I say temporarily as I have all the paperwork to pin this bastard down! It's all about money to get across this stage!
    It's a pity and brutal that law is all about money and lies and not about honesty and true facts!
    I say lies because that judge in the supreme court bought it though he knows and had spelled it out along the hearing numerous time! And yet it's because it's a procedure thing!
    My solicitor and barrister had expectation of 90% chances base from my emails and paperworks that is why I gave it a go,Again ,it's all about procedure!

    The drama and impact going thru broken families( psychologically,emotionally,financially) because of Michael Jolly and his garbage family ,It's something unbearable specially when you were cheated right straight at your face!

    What's wrong with being honest in doing business?
    Is that something to be taken advantage of ?

    I just hope and pray you all get your senses!

    For those suppliers that are still supplying,you all had been burnt and had went to court as well ,why still supplying? Why not support this cause and help put an end ? Are you really short of business or ?
    I do personally know these aluminum suppliers and it's because they just work for big time suppliers in China that they only care for performance and this money owed are only small amounts that they can cover up loses.

    It's really a SHAME that they don't care a bit about whats happening!

  19. I was ripped off by Jolly over a period of over 2 years. Michael Jolly demanded a payment of about $8,000 so that I would have exclusive rights to sell Vollay products in a particular area of Sydney. I later found that at least 3 others were working in the same area. That's 'exclusive'????

    I was fabricating and installing shutters and some other Montage Vollay products.
    Michael Jolly promised to send me leads, but he failed to do so.

    Michael Jolly promised that my business name would be listed on his website which would be 'up' in a few months. The website was not completed for another 18 months and no-one's business was listed except Michael Jolly's Montage, although he posted a photograph of one of my jobs and claimed it was his.
    As time progressed, the situation grew steadily worse. About 2 in 3 deliveries of materials was supplied late, was wholly or partly supplied in the wrong colour, was supplied with missing or incorrect components, powder-coating was often of poor quality and had to be reprocessed.
    I spent more time waiting for materials than I did working. I could never make a profit.

    I gave Jolly a written complaint, detailing my purchase order No.'s and the deficiencies in his supply.
    He told me that my complaint was all bullshit, and that no-one else had any problems at all.
    I contacted a series of his shutter fabrication/installation customers and found that everyone had the same problems that I was experiencing.

    One of Jolly's customers told me several years ago that he believed that Jolly could not supply reliably, because he had no money to pay his suppliers, that Jolly/Montage/Vollay was almost constantly on credit hold. In the light of my experiences, this explanation seemed plausible to me.

    I have made extensive, detailed complaints to ASIC, the ACCC and to NSW Dept. of Fair Trading.
    The ACCC responded and advised me that they would take no action.
    ASIC responded and advised me that they would take no action.
    The NSW Dept. of Fair Trading did not even bother to respond.

    I suggested to the NSW Dept. of Fair Trading that they post a public warning about Michael Jolly, Jill Jolly and their Montage Group (Vollay Contracts, Vollay Systems). They have posted warnings about relatively insignificant unscrupulous dealers, but they have refused to warn the public about Michael Jolly and Jill Jolly.

    Reading the complaints on this site, it intrigues me that the Jolly's are able to keep on taking deposits, but not delivering the goods.

    Where is the money going? Is it in his superannuation, a Swiss bank account, or simply squirrelled away somewhere. Why do the ACCC and ASIC refuse to investigate? They are public bodies, paid for by tax payers. Why do they not do the job that they are there to do.

    Everyone with a complaint should send it to the ACCC, ASIC and the NSW Dept. of Fair Trading.
    Inundate them. Send copies to your local MP's also.
    Statements sent to ACCC and ASIC are confidential (they are not public documents which could lead you into legal difficulties).

    Please do it. I think only the weight of numbers will win this one.

    I see no way of recovering my losses. Jolly with his legal counsel seem to be able to fool the courts repeatedly.

  20. What meeting of creditors with Administrators?
    He'll come good with the 30k to keep trading, and then the Administrators are happy. The best source of dirt on him will come from the people in the complex at 7 Hills, or employees past or present. The only way to bring this bastard down is to infultrate him. Espionage is a lovely word, and money talks when its directed to someone willing to carry it out.
    I think brighter days for all creditors are not far away :)

  21. Spoke to the Administrators office today who confirmed that Michael Jolly had not paid the $30K due on or before 21st January. It is now up to all creditors to contact the Administrator (details above in earlier entry)ASAP, to request a meeting of creditors to be called and for the winding up of the company to proceed.

  22. Creditors should note as one person has pointed out above that Jolly has two other companies: Vollay Contract Pty Ltd and Vollay Systems Pty Ltd. Vollay Contract Pty Ltd was established on 12 November 2008 and Vollay Systems Pty Ltd was established on 2 April 2012 - on the same day the Administrator notified ASIC that the creditors' meeting had decided to set up a Deed of Company Arrangement for Montage Group Pty Ltd (very suspicious). Creditors should be asking the Administrators to investigate whether money has been funneled out of Montage into these other companies.

  23. According to my calcs, Jolly has handed over $45K to the administrators if the payment schedule in the deed has been followed up until the end of September. The funds paid are to be firstly applied to the administrator's costs which are estimated at a total of $88K. The administrator won't be happy if his costs are not met and I think that Jolly could expect a recommendation from the administrator that ASIC go him personally with an insolvent trading claim if he does not come up with the rest.

  24. Been speaking with my Lawyer, who says Jolly has signed up to a major contract in Asia to supply louvres on a multi-million dollar contract. He seems to think he is recieving money from this consortium, but it isn't been funnelled through his business bank accounts, hence the Administrators would not even know about it. Even though this consortium is Asian, the parent group company is Australian. (Makes for easy transactions without any currency exchanges) The company is listed on the ASX as a top 1000 company, with projects worldwide including Dubai where big building projects are at an all time high.

  25. So they had a creditors' meeting today to rubber stamp amendment of the Deed to allow Jolly to pay by 20 Jan the $30K he owed for October, November and December. Someone advised above that the Administrator had told him that Jolly had not paid by 21 Jan. Presumably he has paid and he has another $10K to pay by 31 Jan.

  27. Insurance fraud is a police matter and Elders would be keen to recover a payout made against a false claim. Alert Elders and they will call in the police if appropriate.
    Jolly has many reasons to feel confident - ASIC and ACCC decline to take action, Fair Trading gives him an occasional minor fine and the legal system is ineffectual.
    Where do the customer deposits go? He has few staff to pay, he apparently does not reliably pay his creditors, so where does the money go?

Michael Jolly puts in an insurance claim, the insurance company - Elders - just pay him out, and he trades a little longer, then does it again etc. Mean while insurance companies raise their premiums and we pay whilst Michael Jolly rips off someone else. The system stinks.

    INSURANCE FRAUD Contact Elders and tell them what you know or what you read on here Then they will do something This is a jailable offence
    FAIR TRADING If you have a gripe then contact them They know all about him and will act on every complaint He cant continue to pay fines and he wont comply
    BUILDING COMPANIES If you speak to builders and his name is mentioned just give them this blogsite address They can then make their choice
    If there are any people with inside information then speak up
    We need to keep this going until he is no longer allowed to "run" a business like he has been for years
    This blog is your opportunity to express your thoughts and knowledge so others can be made aware.I am sure that every new customer who reads this will not do business with them One person has already acted on this site and cancelled their order and I am sure there are more that have smelt a rat I found a customer the other day who now knows all about him and has taken his business elsewhere

Any of Michael Jolly's Montage creditors who were involved in last years proceedings with Jolly's administrators and is dissatisfied with the outcome can re-initiate the process with another administrator - ideally one who will investigate more thoroughly and understand what Jolly is really doing. A new administrator would not be constrained by any aspect of the previous administrator's actions. Any creditor contemplating the initiation of independent action would probably need to be owed at least $100K to make it worthwhile. If anyone is interested in considering such action, I will obtain the contact details of an administrator who is well accustomed to this type of situation.

    How the hell can Jolly instigate bankruptcy proceedings against another person while his company is in administration ?
    It smacks of double standards but we all know that Jolly has none of the morals that normal people have
    He also gloats that he never comes off second best

  34. Clause 13(2) of the Deed of Company Arrangement states that:
    The Director covenants to the Administrator to use best endeavours to complete all projects where a deposit had been paid on or before 23 February 2012.
    Clause 17 gives the Administrator the right to terminate the Deed and wind the company up if it fails to comply with the Deed.
    I would like to make a few points about this:
    Firstly, people who had paid a deposit before 23/2/12 and have received nothing should be making this known to the Administrator and demanding that the company be wound up for the Director's failure to comply with the Deed.
    Secondly, the taking of a deposit before a service is provided should correctly be accounted for as a liability - not a sale. Sales revenue should not be recorded until the service has been provided. Therefore, all customers who had paid deposits and not received a service should have been regarded as creditors by the Administrator. They should have been invited to creditors' meetings and have been entitled to vote on whether the company should have been wound up. It seems from the special provisions in the Deed about customer deposits that these people have not been regarded as creditors. I think this is a serious error by the Administrator. People affected should also raise this issue with the Administrator.

  37. I have been told of a large project at melbourns airport that Jolly is involved in I have been told Vertilux in Melbourne have paid Jolly a large amount of money as a deposit but have got nothing in return
    now the builder is talking about suing Vertilux for non supply of goods if this is true can anyone shed more light on this,and what are Vertilux doing about it were has the deposit gone
    if true why have vertilux not taken action in the courts

      How did Vertilux get involved with Jolly?
      I think that is incorrect actually. Jolly owes money to a company in Melbourne that subcontracted to him to put the shutters up at Transport Air Services, (Louvreworks in Melbournes south west.) They completed their job, to which Jolly still owes them a considerable amount of money.
      The builders are aware of this, and they are equally as frustrated by Jolly's constant delays and lies as to why the Louvres are not operating as they should. The technical side of things I'm not to sure about, just how they operate exactly, but it is quite complex in nature I'm told, and Jolly has lost all support from the Company that designed the system. I also believe one of his staff with the technical ability to sort it out has left the company also. Like I said in an earlier post (The complex at 7 Hills has many pairs of eyes and ears)

    Montage took 48k out of 94.6 contract.
    Two years later I got brackets installed,all incorect,just hanging by dynabolts,no chem set ,no stainless steel bolts as promised.Out of 8 panels installed 3.
    All looks like second hand ,full of scratches and dents.
    Montage cannot show engineering certificate to city council satisfaction.
    My structural engineer would NOT sign off.Building inspector from council wouldnt pass either.
    I couldnt get Montage to do anything proper.No institution wants to act.
    NOW MONTAGE DEMAND UNDER SECURITY PAYMENT ACT FULL PAYMENT.
    I couldnt do a thing, but proven dishonest, to say most polite way, people got law on their side.
    They bloody laughing.
    Are we honest people are fouls?
    Above is stated that in March we could vote to close this crooked company.
    Let have no second thoughts,let vote him into liquidation.
    He shouldnt trade.We all know where this family of Jolly belong to.

My accountant says it can be done, and any new administrator is not constrained by the actions of the previous administrator. A few creditors with enough money owed to make it worthwhile.       I am flabbergasted that there are NO testimonials on his new website An oversight perhaps?? Not likely.
      I have not heard a single positive comment about Jolly or his company in over 9 years since I first became involved with him Needless to say I have not dealt with him for more than 4 years
      There is one guy ,Sandy De Luca from Styles and Rails who for whatever reason still works with him but all the rest have taken their business elsewhere

  53. The thing that is hard to understand about Michael Jolly & Jill Jolly is that they hired an engineer to design their products – many of which are attractively styled and appear to be of good quality.
    They used Brent Parkes to design an impressive website that created the impression that there was an organization of substance behind the Vollay brand.
    A great deal of effort and expense went into this work.

    If they had properly organised materials supply, production and installation they would be in a position to take a good share of the market – they could have created a successful business that would make them wealthy.

    But instead, Michael & Jill Jolly preside over an organisational SHAMBLES that they have created through their business INCOMPETENCE, their FAILURE to deal honestly with their customers, their creditors and their staff.

    So why did they bother to do the groundwork when they are so LACKing in SKILLS, knowledge and experience that they can’t follow through and run the business properly and honestly without creating all this STINK? There is something very WRONG with them.

    They are NOT LICENCED for domestic installations, they use unlicensed installers, so their ‘10 Year Warranty’ is useless. They’ve been fined numerous times, but still they continue UNLICENCED.

    They grab deposits, but make no effort to deliver on time. When they have FAILED TO DELIVER and their customers want their deposits returned, they get NASTY with the customers, tell them lies, blame their suppliers, frustrate and delay the customers’ efforts to have their money returned. They behave as if the customers are the problem.

    Some companies earn a good reputation, they gain repeat business from past customers, referrals from satisfied customers.

    Michael Jolly, Jill Jolly get legal action against them, action through Dept. of Fair Trading and blog sites warning people not to deal with them.

    It may look a good product on paper or when designing it but there is NO testing or engineering reports on any of the products
    If he needs an installation signed off all he does is send some drawings to an engineer in Brisbane ,tells him some porkies about how it was done and the engineer may then sign it off without even seeing with his own eyes
    I have yet to see any "talented" people working for him.People with talent dont get paid $18/hr
    Regarding his installers/resellers I personally know of 3 in WA, 3 in QLD ,2 in VIC,3 in NZ and more than 25 in NSW/Sydney who have been burnt by this company over the last 7 years with some of them closing thier businesses as a result of the losses incurred because of thier involvement with Jolly Even today there are some guys fixing up motorised jobs that have never worked properly If a roof systems needs a 20nm motor he will install a 10 or a 5 mn motor because it is cheaper He doesnt care if it burns out in 6 months
    If your powder coat comes off your shutters it is because he often sprays extrusions with aerosol paint
    Then there are the builders developers public who are out of pocket through failure to deliver the goods Even ex staff are owed money for company expenses because they were asked to pay for goods and services using thier own credit cards and not reembursed.
    The guy who helped him get going with the design of the aluminium shutters not only was dudded out of the patent but is still owed over $700K.
    It is only a matter of time before Montage is finished for good(hopefully tomorrow) and VOLLAY SYSTEMS and VOLLAY CONTRACT will not last much longer
    There is NO way a business can continue to operate the way the JOLLY FAMILY operates.And nor should it

Montage made it claim (baseless)on me under building security payment.I was forced to engage practising structural engineer who stated in report that all shutters Montage installed are not complaing with any standarts and HAVE TO BE PULL DOWN.Soon I could I publish damming engineer report on this site I will.
    Frame is dangerous and not calculated for wind load.Mounts are 8 mm galvanised dynabolts instead 10 mm stainles.Used dynabolts instead chemset.All wrong.
    This guys are a cheat.Is anyone need witness in court against them I put my both hands up.

      I think you will find the frames and blades do not meet any wind load rating. Most of the blades in this job are aerofoil blades, Do not have screw flutes I know for sure because I worked on this job and helped screw those bloody blades in. I think from memory every 12th blade had a blade with screw flutes, the rest dont. The screws were falling out of the blades as we were loading them on the ute. The blade was recoated from old stock just to use it all up as not many jobs used the fluteless blade.
      Glad I got out of that joint when I did. That job was fucked before we started it. I didnt think it all got delivered to site anyway

      This is completely out of order The best thing for you is that he took on this job under the Vollay name He may have taken your deposit as Montage and fitted off a few brackets but I have seen his emails and quote for this job on the Vollay letterhead so you can go for Vollay through the courts to
      1. get the job done properly
      or 2. get you money back
      and 3.get Jolly and Vollay a big fine from Fair Trading

      lastly DONT PAY HIM A CENT MORE until this has been resolved If you have a registered dispute he cant make you pay through the Security Payment Act Get hold of the CTTT today and make your claim

      2.No company in Sydney will powder coat anything for them
      3.No engineering workshop will touch them

      This job is completely out of Jollys league and with both his only decent staff members having resigned he is left with no brains in the company to do anything

  58. I too have had dealings with Michael Jolly. I contracted him to install a louvre roof in my home a few years back.

    He explained he only deals through his installer network but he would deal directly with me if I was to structure the transaction through my business.

    I later realised this was simply to enable a 'business to business' transaction allowing him to avoid licencing and other contractual obligations when dealing with the public.

    I paid him a 50% deposit of the $25k job.

    Once he had the deposit, his empty promises and excuses began. I couldn't reach him by phone and had to visit his Seven Hills premises unannounced. His reception was rude and hostile.

    We managed to get the job completed after many many stressful months but required a lot of rectification work by ourselves.

    Although our experience was unpleasant to say the least, we seem to have gotten away relatively unscathed.

    I have been in business for many years and have always conducted my dealings with honesty and integrity. I have always been able to spot a con man a mile away, but I didn't see this grub coming .......

    I always knew if I googled MICHAEL JOLLY's name, I would come across stories like this.

  59. ATO are investigating his non payment of his Employees Superannuation entitlements. They are looking back through a list of past and present employees of several years. This could well and truely find him in a deep financial disposition, as the fines are very heavy for each Non payment to an Employee, plus what they are owed. This could be the icing on the cake. The administrator wanted to wind the company up but an alternative resolution was put up by Jolly to modify the Deed to give him until April 2014 to pay the estimated costs of the administration and a 5% return to creditors. Jolly's resolution failed "on the voices" but the ATO rep asked for a poll. This meant that votes were weighted according to the amount owed. As well over 50% of the debt is to the Jolly family, Jolly won the poll and his resolution to change the Deed was therefore carried. Jolly will win any poll because of this - he can have the Deed changed to his heart's content.

    It is time somebody seeks a winding up by the court as nobody can beat the Jolly family by voting at creditors' meetings.

    I wonder if the new payment schedule makes allowance for the costs of increasing the amount of time that will need to be spent by the Administrator in administrating the deed, legal costs in variations to the Deed etc.

    Purely to steal more money as he got half of sum of contract.
    Building inspector and structural engineer are in opinion(got in writing)that 3 out of 8 panels installed by Sandy are to come down as not complying with any standarts.
    My lawyer filed response to his demand.
    On advice,because we dealing with absolutely dishonest family I sent response by register mail,by normal mail,by fax,by email,by email with cc to administrator and as well delivered personally with two witnesses to their office.
    Asked for signature as prove of delivery and Trent shouted that no one is allowed to receive my letter.
    That shows you real colours of Jollys.

VERY IMPORTANT - You really need to send the registered letter to the registered business address of Montage Group Pty Ltd or Vollay, whatever name Jolly is using, otherwise he will simply pretend that the letter was never received. It is easy for him to do this if it is not sent to the registered address. Check this with your lawyer. When you demand a response, Bruce MacDonald will wait a month or so and send you a letter saying something like 'what registered letter? My client received no such letter.' At this point you will be back to the beginning and you will have lost about 2 months.

  63. Has the administrator determined that Jill Jolly is really a creditor? The Jolly’s sold the family residence which was in Jill’s name (just in case the business collapsed), Jill Jolly inherited at least $400K when her father died. Michael Jolly claimed to have cleverly pulled a substantial amount of money out of investments before the GFC, so conceivably there was $2M or more in Jill Jolly’s name that she could have lent to Montage Group P/L. But where did it go? Apparently not to paying creditors or anything else that much benefited the company. Has it been tracked down? Has it just found its way, via circuitous routes, right back into the Jolly family? Clearly, so long as Michael Jolly maintains the apparent debt to Jill Jolly at an amount sufficiently exceeding the total amount owed to other creditors he can continue to manipulate the situation. I reckon the debt to Jill Jolly is nothing but a Jolly Fantasy.

  70. A few years ago we enquired about enclosing out outdoor entertaining area with aluminium plantation shutters. We spoke to someone at Montage P/L (Michael Jolly or another man) about Vollay shutters and were give an approximate price as a $/sq metre, but we had higher priorities at the time and did not proceed.
    I remember his impressive Montage website, but when I went looking for it recently I found this instead. The Montage website is a shadow of what it was. I looked for Vollay shutters and discovered the website is suspended.
    After seeing this blog website I think I had better look elsewhere for my shutters.
    Michael Jolly had attractive products, but seems to have thrown away a golden opportunity. People like that should not be in business.

Its solely own by the original creator, designer of the vollay 5000 . What the hell does Michael Jolly know about engineering ????? He came to me with just simple hand drawings that even an elementary kid can draw and had no complete idea where to start with . Got all my original drawings and stole away what should be my very first patent in Australia . Anyway, The guy is a con artist and no regards for the human race , Stop dealing with them and do more research on how they cheat their suppliers and customers . After my unfortunate dealings with this despicable family over the past few months and reading about other peoples dealings with them I would have say that this Jolly family is the lowest of the low I could call them scum but scum rises to the top I could call them bottom feeders but parasites would be a better description They have caused my family untold hassles and unpleasantness with their rude and dismissive attitude to the problems they have created through their lies and deceipt As result I have not been able to move into my new home as the products I have paid a considerable deposit for have not materialised.I get fobbed off everytime I call their office and can never get to speak to Mr Jolly as he is always "busy" and my calls are never returned I have tried to cancel the order but was told "you wont get any of your deposit back" and " read our terms and conditions" Please can someone do anything to help us ? Michael Jolly is well known to the Department of Fair Trading, because he is a repeat offender. Don't delay. get it moving tomorrow. It will cost you nothing and you will win without any drama.

  76. Engineer finding re: shutters at Voyager Motel installed by Montage -

    - For this application a much wider spreader plae should be used to distribute the fixing load over multiple bricks.It would be typical to use an angle fixed to the wall that bracket in turn fixes to ensure adequate distributio of ancor loads into the supporting cored brick wall.
    - The dynabolt fasteners ae at their Working Load Limit supporting the self-weight of the louvre frames.With the addition of extra tension loads from potential wind loads the fasteners will be overstressed and subject to pull-ot from the wall.Hence, under a wind storm event the louvre frames could colapse.
    -It was also noted that the louvre frame vertical members displayed significant lateral deflection under minor loads applied by pushing them.This indicates that the vertical members would not be structually adequate to resist lateral wind loads.
    -Significant structural modifications would belikely to the frame to render them structually adequate and compliant with the Australian Standarts and building Code of Australia.
    -Due to the architectual requirements of the louvre frames the addition of multiple supporting members back to the wall WOULD NOT BE ACCEPTABLE.Hence, the REMOVAL of the current frames & the istallation of new louvres that meet both the archtectual brief & astructual adequancy requirements will be required.

    Above text is basically summary of 3 page report done by well known practising structural engineer.

  77. I have seen this job and it is an absolute disgrace It is a mish mash at best
    No thought went into the design at all and Jollys attitude of " stuff the customer , he will get what I give him " will come back to bite him on the bum
    The frames flex when pushed and half the 90mm louvre blades (not 115mm as quoted) will fall out before long because maybe 10% of them are screwed to the frame The rest are held in position by screws that can be pulled out by hand and the louvres will fall out
    I am not surprised that this installation has been condemned as Jollys interpretaion of "engineering" is not the same as most other reputable companies
    I am also told that Jill is looking a little worse for wear as a result of her darling husbands deeds

  83. I am a builder and was told yesterday that Ozzie and Jolly are both bust. So today while it is raining I looked up these two crooks. Both have been hassling me for an order recently. Thank christ I never passed them any money.I will report both of them to ASIC as both of them never legally disclosed of the positions they are in. I must make everyone aware,that Rod Keating is trying to now do dodgy business on the side too. These guys have left me and my clients with out any warranty on products supplied. Deal only with companies that have a history and will be around for years so they can provide a warranty.

    He had to pay fines and compensate his customers as well as serve 1 yrs jail which increased to 2 yrs if he didnt pay the money back

    Over time, with the expansion of the range, overseas clients also saw the disadvantage of products that had not been tested to any standard, and they soon became part of our ex customer base.
    From our factory/warehouse based at Seven Hills in NSW, we havn’t been servicing our customer’s requirements, non supplying a complete range of products Australia wide, specialising in the areas of non delivery of timber venetian and shutter systems.
    During this period, we identified a need to supply economical, integrated light control and energy management systems. We should have invented the light switch!!
    Based on our lack of knowledge and inexperience with blinds and shutters we utilised the natural ventilation characteristics, and began work on our environmentally sensitive systems I don’t know what this means but it sounds good
    In our quest to establish the highest quality range of products, we found it necessary to invest in research and development tools using customers deposits to enable us to achieve our goals. This included the establishment of an internal design facility ( a very small office downstairs) using CAD technology to assist in the ongoing development of our systems but unfortunately our designer has left as he had enough of the bullshit going on upstairs A full time tool maker was employed, enabling us to perform product cycle testing, prototyping and assist in the development of assembly jigs and tooling But he also left for the same reasons
    From our successful?? start in someone else’s design and manufacture of Vollay Aluminium Shutters and Louvres, we have utilised this technology to grow our business in the Commercial arena and now don’t supply one of the most incomprehensive ranges of residential and commercial shutter and louvre systems available in Australia today.
    With a wide range of blades sizes and designs from 45 to 600mm, Vollay customers are able to satisfy their customer’s demands with virtually and project that comes their way. This is further enhanced by the Vollay philosophy of continual product product improvement and our ’boutique’ (what does this mean?) approach to new product design and development enables new products to hit the market very quickly. Except for Singapore where we didn’t have a clue what we were doing How I am ever going to pay back the deposit they paid me ?? Please excuse the grammar and spelling in this paragraph as I didn’t finish school
    Vollay Systems in-house CAD and graphic design facilities no longer offers a complete creative package for the development of technical drawings and point-of-sale material as Jeremy has left , slowing down the creative process and not allowing the client the opportunity to converse with our technical/creative team

    NSW Fair Trading advises me of the following:

    1.Yes.
    2.Montage Group Pty Ltd and Vollay Systems Pty Ltd did share a director until 4 March 2013. Shares in Vollay Systems Pty Ltd are owned by a company that shares a director with Montage Group Pty Ltd.
    There is no company with the name "Montage Group Vollay Contract Pty Ltd" registered with the Australian Securities and Investments Commission.
    3.One complaint lodged against Montage Group Pty Ltd also relates to Vollay Systems Pty Ltd.
    To date, Montage Group Pty Ltd has been issued with penalty notices for unlicensed contracting, taking excessive deposits, and a failure to provide home warranty insurance.

  92. There a a few simple rules to follow if you are contemplating complaining or takng action about the activities of these jerks.

    If complaining, get the company name right - there are three that I know of:

    Montage Group Pty Ltd
    Vollay Systems Pty Ltd
    Vollay Contract Pty Ltd

    Examine your quote / email or whatever and make sure you complain about the entity which has misled you. If you are serving letters of demand or other legal notices, make sure that these are sent to the registered office of the entity with which you have a complaint.

    Go to a NSW Fair Trading Office and complain in person. Take all relevant documents with you, with copies. Fill out the complaint form and make sure you are issued with a case number. Your case will be followed up. Many people complaining on this forum bitch about Jolly and his companies, but do not make official complaints. They are wasting their time unless they make a formal complaint.

    None of the Montage or Vollay companies or Jolly hold contractor's licences and therefore cannot advertise, quote on or undertake any domestic work worth $1K +. He cannot even sign you up and then engage a licensed contractor to undertake the work (not that he seems to associate with any licensed contractors). You need a licence to even advertise the capacity to arrange this type of work.

    Don't just complain on this forum..... ACT!!! Get your deposit back and get him fined - either through NSW Fair Trading and the CTTT or your lawyer. Take action and win. I did.

    At the beginning of 2011 we done deal with Montage to manufacture and install 8 shutters at Voyager Motel for a sum of $86000 ex GST.
    Everything was sweet till Jollys convinced me to give them $47000
    in deposits.
    After I got all lies and excuses.Anyone who talk to Jollys knows how charming they are till they extract money from you.
    For $47000 I got 3 out of 8 shutters which are made of second hand material.Re-powdercoated.I orrdered blades 115 mm Jollys decided to made of 90 mm.ALL HANGING BY FEW SCREWS.
    All dented.Scratched.
    He wanted to be paid more for that scam.He was shouting.He was calling me crook.He was treatening me with someone unknown.
    (anyone was treatened by JOLLYS with bikies before???)
    To my suprise they sent me demand under Builder Security Payment ACT for another $42000.
    Would I not know about that ACT they will do me for another 42K.
    To defend I hire expert building inspector,structural engineer and paid for lawyer to answer they demand.Few thousand of my money again gone.
    I hate day the I walked into Jolly office.
    Not hard to guess that both,engineer and inspector condemned whole structure.
    You will think that they oferred make it good.
    NO.NO.They said they got money and ouldnt talk to me.

    IIS THERE ANYONE STILL WHO WANTS TO DO BUSINESS WITH THIS MOB???

    I am very serious.I feed my MPs with all informations about them.
    Their ex employees contacting me giving me lots information about my job.About how they treat them in workplace.Very interesting stuff.

I applied for a job at vollay I worked for one week and that was more than enough, his employers told me to read the blog he had about him,wasn't surprised to be honest, I've not seen such dodgy work in my life, shutters that aren't designed for structural use, really dodgy installation all set out and designed by Michael jolly, I had to leave this place as I was instructed to do dodgy work, I couldn't do it how is this company allowed to trade?

He is taking panels to Byron bay his loaded in top of the ute, I've carried panels on to pellet the welding was breaking off while we where moving, doesn't have the right welding equipment to do job, powder coating in patches Louvre blades not straight an absolute boggy job, his sold a lemon, no freight company would deliver for him they've all been burnt to, so he is delivering himself lol. His got no shame what so ever he should not get paid a cent for that crap, he should not be allowed to install this as it is not safe, if you read this blog and its your job plz do not except it.

I was employed by Michael to just worked one week & that was too long, he got me to fix job in camden couldn't believe what I seen this job was the worse ive ever seen, feel sorry for customer, Michael asked me the best way to fix it I just said take it all down, I didn't want anything to do with it to be honest, so we pulled down, I've got job all on video and photos of this job, anyway I started to install the way it should've been, he kept calling me asking me if I had finished yet, I said where doing it this way to get it right, he charged the customer 50k for this job not even worth 5k, 8k to sheet ceiling 5mx300 and he used 6mm wall lining villaboard for ceiling & set it with interior top coat for a exterior job..lol he called me into his office to ask me why job hasnt been complete, I said just trying to do job right, his response was ill be out off business if I try to do work right..lol what a joker..,that was enough for me I told him to shove his job and business..

    Who in their right mind would call for a meeting of creditors on 3rd January when 90% of people are on holiday and are unaware of the meeting or could not make it to have their say Demand another meeting with the administrators
    Jolly has money stashed away offshore and property up the Central Coast and Hawkesbury Government agencies should have access to all this information and they should come down on them like a ton of bricks Freeze all their bank accounts and assets until all creditors are paid up in full Then lock him up
    Ruin their lives like they have done to so many over the years

  116. we had a job installed by "shutters by design". A Mr Rod Keating was the salesman. Ozzie was the manager. Yesterday our system stopped working and we went to call the company for repairs. Number has been disconnected. I asked our neighbour who installed his system to be advised it was Montage who wont return their calls for service. I googled Montage to find this blog. jesus. Are these two companies and people related?

    At least in my case is not true.I took 3 quotes. First was from gentleman oririginally from India. That quote I obtained by builder. I decided to see factory and what they do. To my surprise on address supplied was different company. As complex belong to good friend on my I contacted him to find out they flew away one night without paying outstanding lease. Obviously told them goodbye..
    Next quote was few thousand cheaper then Montage.
    I decided not on price.No one could sell better then Jollys.Seen factory. Local. Ten years warranty
    Best promises.
    I was sold NOT on price.I WAS SOLD ON BEST LIES>
    Jollys All deserves master degrees in deception and dishonesty.

    I have to say I am glad that I made Jollys and their companies known to NSW Parliament. Known to Members. Known to Minister.
    I can assure you that Jollys have full attention in Department of Fair Trading. What the privilege to have assigned officer especially to them.
    I feel specially honoured that I was one of three person voted Montage into liquidation.
    Some on blog know that Jollys took AVO against me so I cannot annoy them about money they owe me.
    Next station is ASIC.
    I believe that ASIC is just few steps from investigating conduct of companies under Jollys directorship. Taking deposits while insolvent and giving nothing, but pain to rob innocent people who entrusted them with hard earned monies.
    Still issue of insurance.
    Still issue of licences.
    Guys, what about getting free advertising for our heroes on radio and TV?
    That will come later.
    I paid my deposit to Jollys at the beginning of 2011 and nothing happened except that I got extra costs of taking shutters down and repairing he wall.
    So I decided to deliver free advertising.

    It would seem that the leave of the Supreme Court will be needed for the action to proceed. Are you sure that you signed a contract with Montage Group P/L and not Vollay Systems P/L, as there would appear to be no problem in an action proceeding with against Vollay Systems if it was a party to the contract. Maybe you should speak to your lawyer.

  143. Jolly is nothing but a parasite and a psychopath. Having created the appearance of a genuine business, he has proceeded to run a shambolic operation where he has let down his customers (direct and indirect) and his creditors. He has persisted without appropriate licences, frequently fails to properly complete installations, and he refuses to honour warranties.

    He runs a scam of taking deposits and frustrating customers efforts to either secure delivery of product or have the deposit returned.

    It is not simply that he is incompetent, his behaviour is deliberate - this is his ‘business model'.
    He cares about no-one and relies on his excessive amounts of gall, so extreme that even the courts apparently do not comprehend how bad he is. The whole operation is a fraud.

    I fear that the CTTT, ASIC, ATO etc. will give Jolly another insignificant fine and allow him to continue unabated. They have been largely ineffectual to date.

Whenever Jolly is in a tight corner he just talks verbal diarrhoea - he invents stories at such a rate that opposing legal people and magistrates (people who typically think of themselves as being clever) are baffled by the wall of bullshit and make poor decisions. This will be his technique with the CTTT, ASIC, Police, insurance companies, etc. - "muddy the waters" to create confusion and doubt. I don't know why the legal profession are unable to see through his technique - everyone else understands what is going on - a flood of falsehoods, twisted part truths, and red herrings.     I would think since Jollys crossed my path his lies are becoming irrelevant, as most agencies will look at evidence and we ALL got plenty.
    Same with HON Richard Amery.He is ex police officer, long time MP and before he acted he read all material.

His technique is to go to a new extrusion supplier talking BiG with substantial volume usage. The supplier thinks there will be good business and makes extrusion dies at their own expense and keeps substantial stocks in their Australian warehouse. Panasia has a warehouse in Villawood. Eventually it becomes apparent that Jolly is calling forward much less material than he forecast and is costing too much in storage charges and is well behind with payments, and Panasia refused to extend more credit. I heard that he owed Panasia about $700K. I understand that Panasia gave up pursuing Jolly because of the difficulty and expense of dealing with the Australian legal system and the likelihood that even if they won the case, Jolly would be unable to pay or would dodge payment by going into administration.
    Jolly solved his supply problem by finding another supplier – Trango Aluminium. He followed the same basic procedure till they also refused to supply. Trango demanded “Director’s Guarantee” and a list of his assets. Jolly thought it was hilarious, because, as he stated “. . . all my assets are in my wife’s name.” Eventually Trango agreed to supply extrusions to Jolly, provided that they were ordered and paid for by Jillian Jolly.

    Panasia was using an Australian law firm, some or all members of which were of Chinese origin and hence possessed all the necessary language skills.

    It might be a good time to try to reactivate Panasia’s claim on Jolly – especially as the Jolly’s activities are increasingly under the microscope.

    That would possibly include the company from Singapore who paid him a deposit for Sculptura Ardmore only to cancel the order when he couldn't even deliver the prototypes within a year

    Trango were left $75k out of pocket through Jollys deception and would like to have another go at him

    I hope Jolly doesnt do a runner overseas to escape any more legal action as he has indicated in the past that he wanted to live in the Sth of France He would certainly have the money tucked away somewhere

  158. ASIC & ATO should check flow of funds to family members. Jolly daughters (Megan White & Kimberley Patten [Paton]) are on the payroll, but do not work at Montage/Vollay. Possibly Jolly is funnelling funds through other family members like Trent and Peter Jolly (Michael Jolly's father in Adelaide). The supposed Montage debt of around $2M to Jillian Jolly is most likely fictitious with funds simply being lent by Jill Jolly to Montage and channelled back into secret accounts. Thus Jolly can maintain an apparent debt to his wife that gives her power to over-ride genuine creditors. Why else does Jolly have his daughters on the payroll? To manipulate the situation when under administration.

    He has a range of shutters which are a better design than Jollys and he can deliver to Sydney on around 8 weeks sometimes sooner
    Shutters can also be fabricated locally to ease lead times
    Other products available including a motorised roofing system which is so much better than Jollys.
    Contact him directly He sounds like a good guy who has a good product which he can and will deliver.I know one company who he has supplied and they have had no issues whatsoever Remember he has also been burnt big time by Jolly so needs our support

  162. I love to tell all interested parties that it is confirmed that ALL statuatory bodies in Australia are progressing in investigation of Jollys and his companies.
    It cannot be said when we see results, but optimistically, I say within two months we should know something.
    Most will be privallege information and we might not be informed. We would hope that lots of creditors will be contacted as is almost certain that deposits were taken while insolvent.
    One big question is if money will be found, so Administrator could distribute between us.
    Second question. Lots of people would add more money to see those crooks in jail. Will that happen?
    Lets hope.
    I must add that to forces were strenthen by union which is observing what will happen.
    On subject of factory sale.
    Normally factory like Jollys will fetch about 700k. This one because is on land of other entity, and factory have to be retuned to land owners is not even worth asking price. Person in business will say that factory, with every day, got diminishing value.
    Anyone on blog maybe knows more about Jollys assets? If, please share with us. We might put this information to good use.

  163. Lots of ex employee of Montage contacted me about unpaid superannuation levy by Mr Jollys.
    My accountant is ex ATO and said best to contact ATO on phone nr 131020.
    From that point ATO leads conversation, but you have to have some paperwork as an evidence and supply some facts.
    I know at least two ex employee got already case of unpaid super with ATO so Jollys gang is well known to ATO in every aspect.
    Unpaid super, unpaid taxes, unpaid GST, not lodging BAS, not supplying documentation.
    Once you ring ATO your case become one more of Montage investigation.
    I was present at conference where guy from ATO on telephone link was pointing directors of Montage, Jollys, as very bad guys, not complying ,saying that ATO is looking at Jollys trio activities for a long time.
    Obviously they tried to cheat ATO like they did to anyone who crossed they path.
    Once I asked on this blog for someone who happy with Jolly and his work to come forward.
    NO ONE answered that call. Shows you how bad.
    If you think you were cheated, think that Jollys cheated few law firm and even one barrister. At least they on long list of creditors.
    On another note.
    Anyone like to buy shutters, 3 elements, made of second hand materials, not to specs, recoated from few different colours, dented, scratched as structural engineer ordered to pull down.
    They still hanging on wall at Voyager and anyone welcome to see this most shitty job according to few in shutters business.
    That is monument of cheating Jollys left me with.
    Not wonder I cannot wait when all institutions investigating Montage will put directors in front of Judge.

  164. Another Client was cheated again by Michael Jolly ,This time using Vollay company . Got 30K deposit and nothing happened .Its another Non Retractable system (NRV) . Same old story of taking deposit and no intention of supplying .Tenants moving in soon and no NRV done yet .
    Vollay , Michael Jolly, Trent Jolly, Jillian Jolly - Menace to society. Very evil . Not human at all!

  165. This has been going on for years. That customer should go straight to Fair Trading and lodge a complaint. He will recover his money without the expense of lawyers.

    How many of Jolly’s installation customers have been left with charges for scaffolding or scissor lifts because Jolly failed to deliver by the agreed date and the builder’s scaffold had been dismantled. Many.
    And how often was Jolly willing to bear even part of the cost for his own lack of organisation. Almost never.
    How many such customers have been faced with builders refusing or delaying payment to penalise an installer for late delivery – late delivery because of Michael Jolly’s inability to operate his company. Many.
    And the Jolly’s just don’t care so long as they have taken someone’s money. Are the Jolly’s just psychopaths?

    The Jolly’s have been lax in keeping up with superannuation payments for years and have been reported to the ATO on numerous occasions. The fact that the ATO failed to impose penalties served only to encourage them to go on flouting the law.

    On the matter of Montage going into administration – this was deliberate and planned. They were already trading under Vollay Contracts etc. so that when the shit hit the fan, as it was certain to do, they would write off about 95% of their debts. Jolly continued taking substantial deposits, and reportedly went on a spending spree in the run up to go into administration.

    I believe that Montage has been insolvent for years with suppliers kept on a drip feed. Montage became insolvent because the Jolly’s have no idea of how to run a company and so, once insolvent, they had no possibility of trading out of difficulties. This should become apparent to those doing the investigations.

    He cant even pay to get any extrusion powder coated and asks his customers to pay the powder coater directly so that they can get their product
    He must be trading insolvent There is no other explanation No company can rely on customers deposits to keep them afloat and operating
    Same old story as Montage so it wont be long before one of his customers gets a judgement against him and he rolls over again
    The way he operates is out and out deception but it is now catching up with him

  167. As Department of Fair Trading NSW conducting investigation into Montage/ Vollay anyone with valid issues please contact Mr Brown in Fair Trading.
    Fair Trading is establishing if installations done by Montage carry any warranty as Montage never was, never is, licenced to carry this kind of work.

    Investigation into insurance claims made by Montage are well advanced and in progress.

  169. Here is an interesting piece of information regarding employees Superannuation. Somewhere between the transition of Montage to Volley, there is a period of time that Jolly thinks his employees never were actually employed by him. According to ATO documents there is one quarter period of superannuation payment cycle that shows Montage was no longer trading before Volley started trading, therefor Employees were not entitled to Superannuation.
    ATO requires hard evidence that employees were still actually employees during this transition. (Payslips)
    Funny thing about this - All of my slips show I was still gainfully employed by the "No longer Montage Group" which kind of proves he was trading under a company name that was no longer a company. Another interesting fact. I only ever signed one Tax declaration form, and that was the day I started working for "Montage"
    The ATO informs me that when Volley was the operating company all employees had to sign a new Tax Declaration for that company.
    Well - I never signed one, and the reports from other employees I've spoken to, say they never signed one either.
    So just who signed these Tax Declaration forms ???
    When were they signed? Which might account for the quarterly gap in Superannuation payments that should be due to all employees.
    This to me is fraud IN the highest degree.
    Trading while insolvent.
    Fraud with signing government documents on behalf of employees for Tax evasion and Superannuation purposes. (We are talking about 3 Months worth of unpaid Tax and Superannuation for each employee)
    How many years behind bars do you get for that shit Mr Jolly.
    The evidence is there, it's just a matter of time before it's all presented before you by ATO investigators.

    1. Interesting! Jolly cannot legally operate without Workers Compensation Insurance for his employees. If his staff were not his employees for some purposes, but were his employees for other purposes, then I wonder what he did with Workers Compensation Insurance. He was using GIO who had probably ramped up the premiums following complaints from a few past employees – unlikely any other insurance company would want him, but GIO would keep going in the hope of recouping their losses. Are Jolly’s employees insured? Are they insured as employees of Montage, Vollay, MPJ Investments or some other entity. Looks like he’s caught in a tangle of intriguing contradictions created by his successive attempts to cover his past deceits. He has tried to be just too tricky.

    2. Contact Workcover 131 050 and ask them to find out who Jolly has his Workers' Comp. insurance with, which company you are really employed by and are you properly covered in the case of injury or other work-related event such a work-place abuse.
      Workcover will be very discreet. Jolly is well known to Workcover over previous illegal behaviour.

  170. TO EMPLOYEES OF MONTAGE, VOLLAY OR OTHER COMPANIES OPERATED BY MICHAEL JOLLY & JILL JOLLY

    During proceedings associated with external administration of Montage Pty Ltd, company employees, as creditors, had the right to vote on matters related to whether Montage would be liquidated or be allowed to continue trading.
    Reports emerged that Michael Jolly had pressured his employees to vote as he directed and that those who did not comply would face dismissal.

    Employees should understand that if they are treated unfairly, subjected to abuse in the workplace, or dismissed without proper procedure or without good cause, or pressured to make statements that are not truthful, they should report the matter to Workcover.

    If you are dismissed or feel that you are being abused or unfairly pressured or bullied, Workcover will issue you with a complaint number which will then be reported to Jolly’s insurer (Workers Compensation Insurance).

    The insurance company will investigate and make its decision. If you have a valid complaint you will be supported on the same income that you received while working for Jolly until you find a new job – even if that takes months. Jolly’s insurer will assist you in finding alternative work. The insurance company will cover your legal expenses. In the end Jolly has to pay.

    Gather any supporting documentation that you can and names of supporting witnesses. Don’t take it lightly – you will need to make statements and be prepared for counter-claims to be made by Jolly.

    If several people have the same complaint, act as a group and support one another. Protect yourselves. Don’t tolerate abuse. Don’t be bullied.

    If you have a good case, you will most likely win. Michael Jolly has lost such cases before. He has a documented history of abusive behaviour toward his employees.

  173. In Australia, legislation appears to be drafted deliberately to be inconcise, and to contain many ‘loopholes’. Added to this, legislation is written in antiquated ‘legalese’ language that reads like nonsense to normal people. This ensures that the courts are kept busy interpreting the law and hoards of legal functionaries (solicitors, lawyers, barristers etc.) are able to make masses of money trotting people through the system, wasting time and money and too frequently arriving at what appear to be inappropriate outcomes.

    If the legislation was written clearly and precisely in correct modern English, there would be little for the legal profession to do. It’s seems to be a closed shop, operated to too great a degree for purposes of self-interest.

    Certainly there are numerous checks and balances in the system which are intended to avert unsatisfactory or inappropriate outcomes, but these sometimes seem to be counter-productive.

    That Jolly et al have, for years, been able to disregard the law with virtual impunity is just astounding. How could it give anyone confidence in the legal system or the various government bodies that have the authority to take action against him.
